1. Acceptance of Terms

By accessing or using Scribis ("the Application"), you agree to be bound by these Terms. Scribis is provided by Talkyon ("we," "us," or "our"). If you disagree with any part of these terms, you may not access or use the service.

2. Description of Service & API Usage

Scribis provides AI-assisted transcription and text refinement tools through a hybrid model:

• Integrated Services: For features utilizing our integrated cloud services (e.g., Google Cloud Vertex AI), your usage may be subject to specific quotas or subscription limits defined within the App.
• User-Supplied API Keys (BYOK): If you choose to use your own API keys (e.g., OpenAI, OpenRouter), you are solely responsible for all costs and fees incurred, ensuring compliance with the provider’s terms, and maintaining key security.

3. Data Processing & Privacy

Our data processing practices are governed by our Privacy Policy. By using Scribis, you acknowledge that on-device processing occurs entirely on your hardware, and cloud-based tasks are transmitted via encrypted channels without permanent storage on our servers.

4. User Content & Intellectual Property

• Ownership: You retain full ownership and intellectual property rights to the audio files you upload and the text results generated by Scribis. We claim no ownership over your data.
• Responsibility: You are solely responsible for the content you process. You must ensure you have the necessary rights or permissions to record and transcribe any audio processed through the App.

5. AI Content Disclaimer & Accuracy

• Probabilistic Nature: AI-generated results are probabilistic and may contain inaccuracies, omissions, or "hallucinations."
• No Warranty: We do not warrant the accuracy, completeness, or usefulness of the generated text. Users must review all outputs before professional, legal, or medical use.
• Liability: Talkyon shall not be held liable for any damages, losses, or errors resulting from reliance on AI-generated content.

6. Prohibited Use

You agree not to use Scribis for any unlawful purpose, including but not limited to:

• Recording or transcribing individuals without their legal consent where required by law.
• Attempting to reverse-engineer, decompile, or disrupt the Application’s services.
• Using the service to generate harmful, threatening, or illegal content.

7. Limitation of Liability

The service is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, Talkyon shall not be liable for any indirect, incidental, special, or consequential damages, including loss of data, profits, or API credits.

8. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via App updates or our website. Your continued use of Scribis constitutes your acceptance of the revised Terms.
